Customer Service Agreement
Site Delivery Terms, Delivery Pathways, and Limitation of Liability
Right of Entry and Consent. By requesting an estimate for water delivery, and before form submission checking the “I Agree” checkbox, and specifically requesting site/home entry in the Delivery Instructions, the Client explicitly grants H2O To Go’s. Delivery Staff a limited, revocable license/ permission to enter the Client’s residential, Office, or Industrial site for the sole purpose of delivering and retrieving water bottles, water coolers, and related equipment. Delivery Staff are strictly prohibited from entering any areas of the site other than the designated, ground-floor delivery zone or area (e.g., kitchen, pantry, garage, or immediate entryway, office lobby, break room, or similar such areas), without explicit permission from site personnel authorized to do so (such as the Point Of Contact for the account).
Client Obligations for Safe Pathway. The Client agrees to maintain a safe, unobstructed, and hazard-free path from the exterior property line to the designated delivery zone.
Clear Walkways: All walkways, staircases, hallways, and floors must be completely free of tripping hazards, including but not limited to: toys, loose rugs, electrical cords, debris, and clutter.
Pets Onsite: The Client agrees to secure all household pets in a separate, closed room or secure any outdoor enclosure during the entire designated delivery timeframe. Delivery Staff reserve the right to refuse entry if any pet is unsecured.
Structural and Environmental Limitations. H2O To Go Delivery Staff are strictly prohibited from navigating narrow, unlit, or structurally unstable basements, attics, or secondary floors in private residences and businesses.
Limitation of Liability for Liquid and Property Damage. The Client acknowledges that 3/5 Gallon water bottles are heavy, liquid-filled containers, that are reused repeatedly.
Slow Leaks and Hardwood Protection: While H2O To Go performs standard inspections of all bottles, the Client assumes all responsibility for placing appropriate protective mats, trays, or waterproof barriers beneath bottles set on the floor, water dispensers and storage stacks, particularly on hardwood, laminate, or carpeted flooring.
Waiver of Minor Scuffs: H2O To Go shall not be liable for minor, ordinary wear and tear, including minor carpet impressions or minor scuffs on high-traffic floor pathways, resulting from the standard delivery of heavy items, such as water bottles or related equipment.
Exclusion of Consequential Damage: Except in cases of proven gross negligence or willful misconduct by H2O To Go employees, H2O To Go’s total liability for any property damage (including, without limitation, water damage, floor warping, or mold growth caused by slow bottle leaks) shall be strictly capped at the direct cost of repair, not to exceed $1,000 per incident.
H2O To Go explicitly disclaims all liability for incidental, indirect, or consequential damages.
